1. Agreement

These Terms & Conditions ("Terms") govern your use of www.dhakayeah.ca (the "Site") and any order you place with DhakaYeah ("we", "us", or "our"). By using the Site or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. About our service

DhakaYeah is located at Unit 6, 8086 130 Street, Surrey, BC V3W 8J9. The Site lets you browse our menu and place orders for pickup at our restaurant. Delivery may be offered through third-party platforms such as Uber Eats, DoorDash, Skip The Dishes, and Fantuan, subject to their terms, prices, fees, and delivery areas. Their menus and prices may differ from ours.

3. Hours and availability

Our posted hours are daily, 4:00 PM to 12:00 AM. Hours may change for holidays, staffing, or other reasons. Menu items may be unavailable or sell out, and we may change or remove items without notice.

4. Placing orders

• You must provide accurate name, phone, and email details so we can process your order and contact you about it.
• Orders are subject to item availability and confirmation by DhakaYeah. We may decline or cancel an order if an item is unavailable, we are closing, there is a pricing error, or we suspect fraud. If a paid order is cancelled, we will contact you about an appropriate refund.
• Preparation times are estimates, not guarantees. Please collect your order promptly when it is ready. TODO: Confirm the pickup hold period and the policy for orders that are not collected.

5. Prices, taxes, and payment

• Prices are shown in Canadian dollars (CAD). Applicable taxes are calculated at checkout.
• Prices and menu items may change. We make reasonable efforts to keep the Site accurate, but errors can occur. We may correct an error, including by cancelling an affected order and contacting you about any payment or refund.
• The Site does not currently process card payments directly. Any payment instructions or payment link provided separately for an order are subject to the provider's terms. TODO: Confirm the payment provider, accepted payment methods, and final payment process before publishing.

6. Cancellations and refunds

Contact us as soon as possible at +1 (672) 922-7677 if you need to change or cancel an order or if an order is missing or incorrect. Orders placed through third-party platforms are subject to those platforms' cancellation and refund rules. 7. Food allergies and dietary needs

Menu descriptions may not list every ingredient. If you have a food allergy or dietary restriction, contact us before ordering so we can discuss your request. We cannot guarantee that an item is free from allergens or cross-contact. Information about dietary status should be confirmed with us if it is important to you. 8. Menu content and images

Photos and descriptions are illustrative. Actual dishes may differ slightly in appearance, portion, or ingredients, and ingredients may change based on availability.

9. Acceptable use

You agree not to use the Site for unlawful or fraudulent purposes, place false or abusive orders, interfere with the Site or its security, attempt to access restricted areas, copy Site content or menu data in bulk without permission, or upload malicious code or harmful content. We may restrict access where necessary to protect the Site and its users.

10. Intellectual property

The Site and its content, including the DhakaYeah name, logo, text, menu, photographs, and design, are owned by DhakaYeah or its licensors and are protected by intellectual property laws. You may use the Site for personal, non-commercial purposes. Other copying, modification, or distribution requires our written permission.

11. Third-party links and services

The Site may link to third-party services, including delivery platforms, maps, and social media. We do not control or take responsibility for their content, availability, or practices. Your use of those services is subject to their own terms and policies.

12. Disclaimers

The Site is provided "as is" and "as available". To the extent permitted by law, we do not guarantee that it will be uninterrupted, secure, or error-free. Nothing in these Terms limits rights under consumer protection laws that cannot be waived.

13. Limitation of liability

To the fullest extent permitted by law, DhakaYeah and its owners, employees, and agents are not liable for indirect, incidental, special, or consequential damages, or loss of profits, arising from use of the Site or our services. Our total liability for a claim relating to an order is limited to the amount paid for that order. Nothing in these Terms excludes liability that cannot be excluded by law, including liability for negligence or fraud.

14. Indemnity

To the extent permitted by law, you agree to compensate DhakaYeah for claims, losses, or expenses arising from your breach of these Terms or misuse of the Site.

15. Changes to these Terms

We may update these Terms from time to time. The current version will be posted on this page with an updated date. Continued use of the Site after changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Disputes are subject to the courts of British Columbia, except where applicable consumer law gives you the right to bring a claim elsewhere.
